1. SUBJECT
This Preliminary Information Form aims to inform the BUYER, in accordance with Article 5 of the Regulation, regarding the essential characteristics, price, payment, performance, right of withdrawal, and refund conditions of the Vibseen Insight digital subscription service to be purchased electronically by the BUYER through the SELLER’s website/application at https://insight.vibseen.com/.

4. ESSENTIAL CHARACTERISTICS OF THE SERVICE
Nature of the Service: Vibseen Insight is a cloud-based (SaaS) analysis and reporting service that monitors, measures, and reports the visibility of brands on AI-based search and answer engines (such as ChatGPT, Gemini, Perplexity, Google AI Overviews, etc.), while offering competitor analysis, citation/source tracking, and content recommendations.
No Guarantee of Results: Vibseen Insight provides analytical insights; it does not guarantee outcomes such as visibility, citations, or mentions. These outputs depend on the BUYER's current online presence, third-party data sources, and external systems beyond the SELLER's control.
5. FUNCTIONALITY AND TECHNICAL REQUIREMENTS OF DIGITAL CONTENT
• Functionality: The service is provided through a web-based dashboard; it includes data analysis, reporting, and insight modules.
• Technical Requirements: A device with an internet connection and an up-to-date web browser (Chrome, Safari, Edge, Firefox) is required. No separate software installation is necessary.
• Interoperability: The service is compatible with standard web browsers; the BUYER may need to connect their own accounts (e.g., Google Analytics, Search Console, Cloudflare, Shopify) for certain functionalities.
6. PERFORMANCE of SERVICE (DELIVERY)
The service is digital and does not involve physical delivery. Upon successful completion of the payment, the BUYER’s account is immediately activated, and the service is instantly initiated electronically.
7. SUBSCRIPTION AND AUTOMATIC RENEWAL
• The service is subscription-based and automatically renews every 30 days, or annually for annual subscriptions, unless canceled; the relevant period fee is automatically charged.
• By entering payment information and starting the subscription, the BUYER explicitly consents to recurring charges and the renewal cycle.
• The BUYER can cancel their subscription at any time via account settings > subscription screen, or by notifying hello@vibseen.com; canceling is just as easy as signing up.
• Cancellation takes effect at the end of the current billing cycle. Failure to cancel prior to the renewal date does not grant a refund right.
8. RIGHT OF WITHDRAWAL AND TERMS OF USE
• As a rule, the consumer has the right to withdraw from the contract within 14 (fourteen) days of the performance of the service without giving any reason and without paying any penalty.
• However, since this service qualifies as a "service performed instantly in an electronic environment" (see Article 9), the right of withdrawal expires once access to the service has been granted.
• Prior to access: If payment has been made but the service has never been accessed, the BUYER may exercise their right of withdrawal within 14 days by submitting a written request to hello@vibseen.com; the paid amount will be refunded to the same payment method within 14 days.

9. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
Pursuant to Article 15/1-(ğ) of the Regulation on Distance Contracts, the consumer does not have a right of withdrawal regarding contracts for services performed instantly in an electronic environment.
Since Vibseen Insight is a digital service opened for instant access post-payment, the right of withdrawal is waived once the BUYER logs into the account / starts using the service. The BUYER explicitly accepts this provision by confirming this form and the Distance Sales Agreement at the payment step.
10. REFUND CONDITIONS (SUMMARY)
• Due to the nature of instantly performed digital services, automatic refunds are not issued once usage has commenced.
• Refunds are evaluated only in exceptional circumstances (verified technical failures preventing access to the platform, billing errors originating from the SELLER's systems) on a case-by-case basis.
• Details can be found in the “Cancellation and Refund Policy” document. Statutorily required refund conditions remain reserved.
11. PROTECTION OF PERSONAL DATA
Personal data belonging to the BUYER is processed in accordance with the KVKK No. 6698 and relevant legislation. For the provision of the service, data may need to be shared with domestic/international technology infrastructure providers and payment institutions. 12. COMPLAINTS AND RESOLUTION OF DISPUTES
The BUYER may forward their complaints and objections primarily to the SELLER at hello@vibseen.com. In the event of a dispute, Consumer Arbitration Committees within the monetary limits set annually by the Ministry of Trade in the BUYER's place of residence or where the transaction was made, and Consumer Courts for disputes exceeding these limits, shall have jurisdiction.
13. GENERAL
• This form is an integral annex of the Distance Sales Agreement and shall be construed together with it.
• The BUYER acknowledges, declares, and undertakes that they have read and electronically approved this form and the Distance Sales Agreement prior to payment, and that they have been accurately and completely informed about the essential characteristics of the service, sales price, payment terms, performance, right of withdrawal, and refund conditions.
